Terms & Conditions
§ 1 Scope of application
- The following “terms & conditions” apply to the attendance of events (seminars, training courses, workshops, events, ...) held by itemis AG. Deviating arrangements must be made in written form.
§ 2 Application
- Application is required for all events. You can apply in person, in writing, via fax, via internet or by telephone. You will immediately receive an application confirmation in text (§ 126a BGB) or in written form. Without written application confirmation there is no claim to participate. The confirmation mail sent immediately after your application serves only for your information and as a confirmation that you have applied with us for a specific seminar. It does not constitute acceptance of your offer. Before acceptance we must first verify if there are a sufficient number of seats available.
- Through your application you accept the terms and conditions of itemis AG.
- The application is binding and, in case of events subject to a charge, obligates you to pay that charge.
- The applications are processed in the order in which they are received. The processing of an application is only binding with the declaration of the applicant's address.
§ 3 Payment of fees
- The billing of participants takes place in the run-up to the event.
- Companies and institutions pay by invoice with a payment period of 14 days from the date of invoice.
§ 4 Program changes, cancellations
- Because of the long-term planning of events, itemis AG reserves the right of program changes such as changes of dates, start times, location or lecturers as well as event cancellations due to organizational causes.
- Claims against itemis AG, whether for reimbursement of expenses incurred or otherwise, may not be derived therefrom. The same applies to short notice postponements.
§ 5 Withdrawal, refunding, additional costs
- Prepaid fees will be refunded whenever an event does not take place (e.g. due to low attendance or illness of the lecturer ). Further claims against itemis AG are not possible.
- A withdrawal without charge is possible 15 days before the event. Within 14 days of the event, 50% of the course fees are to be paid as cancellation costs. In the case of cancellation on the day the course begins, a full payment is due.
- Withdrawal in accordance with the conditions specified above are to be in each case explained in writing to itemis AG. Absence from the event or a verbal notification shall not constitute withdrawal. For the calculation of the periods of time, the start dates set by itemis AG are applicable.
- It is possible for withdrawing participant(s) to be replaced by a substitute(s). With their mandatory registration the cancellation costs of the withdrawal are void.
§ 6 Liability for occurring damage
- itemis AG generally accepts no liability for damage, accident, loss, delays or other irregularities. It also accepts no liability for any damage, loss or theft of personal items, clothing and educational materials to the participants.
- Participants are liable for inflicted damage to itemis AG as a result of their behavior.
§ 7 Miscellaneous
- itemis AG is entitled to put the participants or their companies into its customer list.
- Should a clause from this agreement or the respective supplementary agreement be or become ineffective, it does not affect the effectiveness of this agreement and the supplementary agreements in all other respects.
- The parties agree, concerning all legal relations of this contract, the application of the law of the Federal Republic of Germany.
- Provided that the customer is a trader within the meaning of the code of commercial law, corporate body under public law or trustee of public-sector fund, for all disputes, which develop in the context of the completion of this contractual relation, Lünen is agreed upon as exclusive venue of jurisdiction.
